Compliance Alert | Annual Notice Regarding 2026 ACA Affordability

The required annual notice, Health Insurance Marketplace Coverage Options and Your Health Coverage, has been updated to reflect the 2026 Affordable Care Act (ACA) affordability percentage of 9.96%. There are two versions of this notice:

  • Health Insurance Marketplace Coverage Options and Your Health Coverage | For Employers that Offer a Health Plan to Some or All Employees (for employers offering health coverage in 2026) (click here to download), and
  • Health Insurance Marketplace Coverage Options and Your Health Coverage | For Employers that Do Not Offer a Health Plan (for employers not offering health coverage in 2026). (click here to download)

 

Please distribute the version applicable to your organization to ensure compliance for the 2026 plan year. As a reminder, employers that sponsor group health plans must provide certain benefit notices in connection with their plans’ open enrollment periods.  Although these annual notices may be provided at different times throughout the year, employers often choose to include them in the new hire packet, at open enrollment for administrative convenience, or annually post open enrollment to your company intranet.
